1. Terminology

In these conditions, except where the context otherwise defines:

‘Client’ means any Institute, firm, organisation, individual or other body or person for whom the Programme is provided.

'Institute' means The Institute of Business and Management Ltd (IBAM).

‘Programme’ means a programme of study offered by the Institute.

2. Applications

Clients wishing to join a Programme must complete an application form and submit with other necessary documentation as specified within the Institute brochure. Applications must be received within a 12-month period prior to the commencement of the specified Programme. The Client must satisfy the Professional Body or University entry requirements for the selected Programme and provide appropriate evidence, in order to be considered.

If the Client is resident in the UK they confirm that they are legally resident in the UK.

The Client understands and accepts that should they seek out or receive support for their Programme from any third party without the prior written permission of the Company then this will result in immediate termination of their Programme.

Programme places are allocated to a client on payment of fees, deposit or evidence of Student Loan Agreement.

3. Overseas students

IBAM is able to accept international students who satisfy UK Border Agency requirements to study in the UK and who hold the appropriate study Visa.

The Institute is legally oblidged to provide the UK Border Agency with personal data relating to the Client as required by the UK Government.

4. Programmes and Fees

The Institute may vary Programme fees without notice.

Programmes may be withdrawn by the Institute without notice.

An application charge of £500 is included in all programme fees.

Programme fees may not include registration or membership of relevant professional bodies. Please refer to the published list of Institute fees at www.ibam.co.uk.

In the event of assessment failure, a re-assessment fee will be payable in advance of the re-assessment.

Clients enrolling in September 2011 will be held for the client for a maximum study period of 3 years.

Clients applying for Student Funding, Loans and Maintenance will be required to pay a deposit of £1000 before enrolment unless the client can produce the Institute with evidence of a Student Loan Agreement in place. Deposit will be refunded on production of evidence of Student Loan Agreement which covers the programme fees. If no evidence is provided by the client, deposit is non-refundable and will be used to cover the client's initial fee. The client will then be asked to provide payment to cover the remainder of the year of study. 

The Institute is in no way responsible for a client's application for student loans, funding or maintenance. Clients are guided to read all the information on the direct.gov.uk website before application for funding. All figures quoted for student funding are taken from the direct.gov.uk website on 30/06/11.

International student fees

  • For all 1 and 2 year Programmes 50% of the fee must be paid prior to issuing a UK student CAS, with 25% of the fee due at the end of Term 1 and the final 25% of the fee due at the end of Term 2. Full payment of the Programme fee must be received prior to end of the first year of study.
  • For 3 year Programmes 50% of the fee must be paid prior to issuing a UK student CAS, with 25% of the fee due at the end of Term 3 and the final 25% of the fee due at the end of Term 6. 

5. Once enrolled, students are liable to pay their fees in full.

IBAM reserves the right to cancel the Programme, tutor support, assessment and to withhold the issuing of qualification certificates in the event of non-payment or part non-payment of Programme fees.

6. Delayed fees

Should Programme fees be delayed beyond the date of Registration or a specific agreed time authorised by the IBAM Bursar, a 2% monthly compound interest will be charged on the outstanding balance.

7. Programme duration and content

Tutor support will be available for the duration of a Programme as detailed in the Institute brochure. After this time tutor support will cease.

Programme commencement is subject to a minimum cohort size. Applicants and students enrolled on programmes where minimum cohort size is not reached may be transfered to an alternative programme if available.

8. Each course or part thereof ends no later than the commencement of examinations.

9. Programme materials

Client Programme materials in conjunction with tutor support are designed to provide the information and knowledge required for the Client to successfully complete the Programme. Additional reading recommendations are available for areas of special interest to Clients and these should be purchased by the Client separately as appropriate.

A study timetable is designed to help the Client to prepare for assessment. It is recommended that Clients follow the guidelines given. If Clients are not able to meet assessment deadlines they must contact the Institute immediately. Failure to meet assessment deadlines may result in an additional fee, depending upon the Programme studied.

Assignments should be returned to the Institute, these will be marked and relevant feedback provided. Resubmission of assignments may be possible, at the discretion the Institute and the accrediting partner.

Where it is specified, the Institute will register Clients for examinations. For all other Programmes it will be necessary for the Client to contact the relevant professional body to arrange examinations directly. Responsibility for these arrangements will lie with the Client.

The Institute reserves the right to inform a student’s sponsor(s) of the academic or attendance performance of the student only if requested by the sponsor(s).

10. Change of Programme

Students who wish to change to an alternative Programme of study offered by the Institute, within the first two weeks of commencing their studies at the Institute may do so. However, if a student wishes to change to an alternative Programme of study offered by the Institute they will be considered to have started their second choice at the time that course commenced and will be expected to undertake any work missed with the guidance of the tutors and/or course tutor.

11. Campus Transfer

Students who wish to apply for a transfer to another IBAM campus should complete an application form and submit it to the IBAM campus manager. If the application is successful then a £500 Administration Fee will fall due immediately and must be paid to IBAM prior to the transfer being agreed. Additionally, if the fees at the new IBAM campus are lower then no discount or refund will be due to the student. If the fees at the new IBAM campus are higher then the difference must be paid prior to the transfer being agreed. 

12a. Refunds

(i) A refund may be made to students before a Visa is issued subject to the student seeking advice from IBAM. Under no circumstances is the application charge of £500 refundable.

(ii) A full refund will be made to students who are refused a Visa but the original visa refusal letter will be required for the refund to be approved.

(iii) Under no circumstances will a refund will be made for the first term, once a Visa is granted. For clarity, if a student wishes to transfer to another Institution or withdraw from their course once a Visa has been granted they will not be eligible to apply for a refund for the minimum requirement paid.

(iv) If you have received a scholarship under no circumstances will a refund be made once a Visa has been granted.

In all cases refund applications can only be considered once the relevant refund form has been completed and has been handed to the Registrar.

Refunds are only given in keeping with any exchange or immigration regulations, or an Embassy, Consulate, High Commission or parent or guardian rules or instructions which may apply and are normally refunded to the student’s overseas address.Where a student withdraws to attend another college IBAM will only transfer the student’s funds to BAC accredited colleges, public funded colleges/universities or college/universities accredited by the department of education of the country by whom accreditation would be confirmed. IBAM will not transfer funds to colleges outside the UK.

Students who arrive late for their intended Programme of study must pay the full fee for the Programme.

Refund of goods purchased under a promotional offer will be based on the terms of the promotional price.

12b. Refund and Progression Policy for a Pre-sessional Course

(i) If a student fails the IELTS (or equivalent) test during or at the end of the Pre-sessional course no refund is available.

(ii) Dependent on the level of the failure of the IELTS (or equivalent) test, students may be considered for an extension of their English classes at additional cost to the student. However these additional English classes will reduce the amount of time allowed within the existing student’s visa duration to complete the following degree programme. If required, it will be the responsibility of the student to apply to extend their visa at the appropriate time and to pay any UKBA fees due.

(iii) Failure of the IELTS (or equivalent) test may mean that a student is refused entry on to their degree course and may require them to seek alternative UKBA approved study arrangements or to leave the country. It is therefore essential that a student’s stated English Level on entry is accurate and that they are committed to improving their English capability within the agreed timescale of the Pre-sessional course.

(iv) If a student fails the IELTS (or equivalent) test after the 3 or 6 month Pre-sessional course this failure is the students responsibility alone. Having provided the Pre-sessional course as agreed, IBAM is not in any way responsible for the failure of an English Language test by a student. 

13. Illness

A certificate of inability to attend the College from an approved doctor is necessary in making claims for a refund where a student withdraws because of serious illness.

14. Termination and withdrawal of programmes.

False information on the application form may render the student liable to dismissal.

The Client understands and accepts that the Institute reserves the right to modify, withdraw or terminate any Programme at any time without prior notice.

The Client understands and accepts that the Institute reserves the right to terminate any individual's Programme at any time and without prior notice.

The Institute is not oblidged to provide reasons regarding termination or withdrawal of any Programme to any parties.

15. The Institute reserves the right:
(a) to revise class schedules or rearrange classes where this is considered necessary.
(b) to cancel at its discretion, classes of less than eight students.
(c) to change the dates/times of the Programme delivery schedule.

Should situation (b) occur, the Institute will endeavour to place the student (if requested by the student) on a similar or identical course at another college.

16. IBAM Refer a Friend

  • 'referer' means the person who fills in the form and refers their friend.
  • 'referee' means the friend who is referred.

Please note: This offer does not apply to referees who are existing IBAM applicants or students. 

This offer only applies to referers who apply and pay direct to IBAM and NOT through third-party agents.

To be eligible to receive a refer a friend discount the referer must be a current IBAM student fully enrolled on a course.

To be eligible to receive 5% discount on  their total course fee both referer and referee must each register, enrol and pay for their first year of study on an IBAM course. The 5% discount will be deducted from their final course fee payment to IBAM.

There is no limit to the number of referees a referer can have. Each successful referral will give eligibility for a further 5% discount from the referer's total course fee.

This offer is valid for 12 months from the receipt of a refer a friend application received via www.rdi.co.uk/refer.

Please note: students receiving funding from Student Finance England remain eligible only for £100 vouchers on being referred or successfully referring other students. 

No cash alternative is available.

IBAM's decision on eligibility for the refer a friend offer is final.

17. IBAM Centres

IBAM reserves the right to change the location of its centres within the cities in which centres may be located or add additional centres.

18. Communications opt-in
By registering you consent to receive communications from the Institute using your registered details, for the time being. Any personal data collected through our websites will be treated in accordance with the Data Protection Act 1998. While students’ files are generally treated as confidential, the Institute will not be liable for any information intentionally or unintentionally provided to, or obtained by, any third party. Please note your personal data will be transferred to Capella University which have committed (by way of contractual undertakings to us) to the same levels of protection for your personal data as we are required to adhere to under the Data Protection Act 1998. This transfer is for the purposes of  administration. For this reason we will require your explicit consent to carry out such procedure.  By agreeing to these terms and conditions you are providing such consent when you register or apply on our website or otherwise submit your personal information to us.

19. Payment/Bank charges
When making payment by bank transfer the student will be liable for all transfer fees incurred.

20. Any monies received by the Institute from the student’s parent, guardian or sponsor on his or her behalf will, after clearance through the bank used by the Institute, be paid to the student only and not to any other person and will be paid via a non-negotiable crossed cheque. 

21. Website Terms and Conditions
Your use of the information, graphics and materials on any of the Institute websites is governed by these WEBSITE TERMS & CONDITIONS.

22. Irrespective of any information provided verbally by the staff or agents of IBAM, all applicants and students will be subject to the conditions stated herein, as well as regulations provided in the Institute’s Student Manual. The document is available on request from the Admissions Office of the Institute and is given to each student at the start of their course.

23. In the event of closure of the the Institute through an Act of God, War or Political or Industrial unrest that may cause temporary cessation of class schedules, the Institute will endeavour to ensure students recommence studies at the Institute or one of its associated colleges. 

Jurisdiction
Our websites are provided primarily for use by residents of the United Kingdom.  The laws applicable to disputes arising from material on our websites are the laws of England and you submit to the non-exclusive jurisdiction of the English courts.

Acceptance of and Changes to our Website Terms & Conditions You acknowledge and accept that your use of our websites indicates your acceptance of these WEBSITE TERMS & CONDITIONS.  We reserve any rights not expressly granted in these WEBSITE TERMS & CONDITIONS.
